Cancellation for digital content

For the purposes of this cancellation policy, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

This cancellation policy applies to contracts for digital content that is not provided on a physical data carrier.

In connection with my recording studio, this particularly concerns digital audio results that are created, exported, provided or digitally transmitted after a booking or commission.

If a service consists of both a personal recording studio service and digital content, the regulations of the general cancellation policy for services may also apply.

As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day the contract is concluded.

This right of withdrawal also applies in principle to digital content, unless it expires prematurely according to the legal requirements.

For digital content, the time limit begins upon conclusion of the contract.

To meet the cancellation deadline, it is sufficient that you send the notification of exercising your right of cancellation before the cancellation period expires.

To exercise your right of withdrawal, you must inform Fabian Günther, Tonstudio Leipzig, Bernhard Göring Straße 17, 04107 Leipzig, by means of a clear declaration of your decision to withdraw from this contract.

You can use the attached sample cancellation form for this purpose. However, using this form is not mandatory.

The right of withdrawal expires prematurely in the case of a contract for digital content not supplied on a physical medium if I have begun performance of the contract after you have expressly agreed that I will begin performance of the contract before the expiry of the withdrawal period and you have acknowledged that you will lose your right of withdrawal by giving your consent to the commencement of performance.

This applies in particular to digital audio files that are individually created, edited, exported or provided digitally for you.

I begin to execute digital content in particular when I create, finalize, export, convert, upload, unlock, or make digital audio content available to you via a digital transmission channel.

This includes in particular WAV files, MP3 files, master files, mix files, stems, voice recordings, podcast files, instrumental files and other digital audio results.

A simple consultation or a general inquiry does not constitute the provision of digital content.

If you effectively cancel this contract and the right of cancellation has not expired prematurely, I will reimburse you for all payments I have received from you without undue delay and at the latest within fourteen days from the day on which I received notification of your cancellation of this contract.

For this refund, I will use the same payment method you used for the original transaction, unless we have explicitly agreed otherwise. Under no circumstances will you be charged any fees for this refund.

If you have expressly requested that I begin performance before the expiry of the withdrawal period, and the legal requirements for the premature expiry of the right of withdrawal are met, there is no longer a right of withdrawal after performance has begun.

Please provide your order number, the ordered product and your name so that I can clearly identify your cancellation.

This cancellation policy applies to digital content. For services only, such as recording sessions, mixing, mastering, editing, consulting, or workshops, the general cancellation policy for services may also apply.

If an order includes both a personal service and digital content, a distinction is made on a case-by-case basis as to which part of the contract is affected.

Should individual provisions of this cancellation policy be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory regulations apply.

This cancellation policy does not replace an individual assessment in each case. The specific contract, the specific order, and the applicable legal regulations are decisive.
